In any democratic society, political parties, candidates and campaigners must be able to communicate effectively with constituents in order to inform, engage and mobilise the electorate. Such communication is a fundamental component of political participation and pluralistic debate. However, the integrity of electoral processes and public trust in democratic institutions depend equally on ensuring that these activities are conducted responsibly. In this regard, it is essential that all personal data used in the context of political campaigning is handled and processed in full compliance with applicable data protection laws.
The increasing reliance on data-driven campaigning techniques, including targeted messaging and digital outreach, further underscores the importance of safeguarding individuals’ fundamental rights and freedoms, particularly the right to privacy and the protection of personal data. Political actors must therefore strike a careful balance between effective engagement with voters and the lawful, fair and transparent processing of personal data.
The Guidelines on the Processing of Personal Data for Political Campaigning Purposes have been adopted with the aim of providing a clear, coherent and consistent interpretation of the application of the General Data Protection Regulation and the Data Protection Act (Chapter 586 of the Laws of Malta) within the political context. They seek to clarify how these legal frameworks apply to the various activities undertaken by political parties, candidates and other actors involved in campaigning.
In particular, the Guidelines address the processing of personal data for the purposes of political communication, canvassing, voter engagement and the promotion of political ideologies and messages across different channels. They are intended to assist controllers in understanding their legal obligations, promoting compliance with data protection principles and fostering a culture of accountability in political campaigning practices.
Ultimately, adherence to these Guidelines is not only a legal requirement but also a key element in maintaining public confidence in the democratic process. By ensuring that personal data is processed in a lawful and ethical manner, political actors contribute to the protection of individuals’ rights while supporting the transparency and integrity of electoral activities.
